1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of GPT Image Prompt, including the website at gptimageprompt.online, accounts, subscriptions, credits, prompt tools, AI image-related workflows, and support services (together, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility

You may use the Services only if you can form a legally binding agreement. You must be at least 18 years old, or at least the minimum digital consent age in your location and using the Services with permission from a parent or legal guardian.

You may not use the Services if applicable law, sanctions, export controls, or platform restrictions prohibit you from doing so.

3. Accounts and Security

Some features require an account. You agree to provide accurate information, keep your login credentials secure, and promptly update information that changes. You are responsible for activity under your account unless the activity results from our failure to apply reasonable security measures.

We may require email verification, OAuth authentication, additional security checks, or other steps before allowing access to certain features.

4. Paid Plans, Credits, and Billing

GPT Image Prompt may offer free access, paid subscriptions, lifetime plans, credit packages, or other paid features.

• Payment processor: Payments are processed by Stripe. Your use of Stripe checkout, invoices, payment methods, and related payment pages may be subject to Stripe's own terms and privacy policy.
• Subscriptions: Subscription plans renew automatically unless canceled before the next billing date. Cancellation normally takes effect at the end of the current billing period.
• Credits: Credits may be granted through registration gifts, subscriptions, renewals, lifetime allocations, or purchases. Credits may expire according to the plan or package terms shown at purchase.
• Taxes: Prices may exclude taxes. Applicable VAT, GST, sales tax, or other charges may be calculated during checkout.
• Refunds: Unless required by law, paid fees are generally non-refundable once credits are delivered, a billing period begins, or AI compute resources are consumed. If you believe a charge was made in error or a service failure prevented use, contact support@gptimageprompt.online and we will review the request in good faith.

5. AI Inputs, Outputs, and Content Rights

You keep ownership of the prompts, files, images, and other content you submit to the Services ("Inputs"). Subject to your compliance with these Terms and applicable law, you may use outputs generated through the Services ("Outputs") for personal or commercial purposes.

You grant us a limited, worldwide, non-exclusive license to host, process, transmit, reproduce, display, and store Inputs and Outputs only as needed to operate the Services, provide account history, enforce safety rules, comply with law, and improve reliability and user experience.

You are responsible for ensuring that your Inputs and your use of Outputs do not infringe third-party rights, violate law, or breach platform policies. AI systems can produce inaccurate, unexpected, or similar content, so you should review Outputs before relying on or publishing them.

6. Acceptable Use

You agree not to use the Services to create, upload, distribute, or request:

• Illegal content or activity, including exploitation of minors, terrorism, or instructions for serious harm.
• Content that infringes copyrights, trademarks, publicity rights, privacy rights, or other rights of third parties.
• Non-consensual intimate imagery, sexual content involving minors, or sexual exploitation.
• Deceptive impersonation, misleading deepfakes, fraud, phishing, or social engineering.
• Harassment, threats, hate content, or content promoting violence against protected groups.
• Malware, scraping, credential theft, spam, or attempts to bypass security, rate limits, credits, or access controls.

We may throttle usage, remove content, suspend features, cancel credits, or terminate accounts if we reasonably believe the Services are being misused.

7. Intellectual Property

GPT Image Prompt, including the website, interface, branding, software, documentation, templates, and non-user content, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer any rights in our technology or brand to you.

You may not copy, resell, reverse engineer, or create competing services from non-public parts of GPT Image Prompt except where applicable law allows it.

8. Third-Party Services

The Services may integrate with third-party providers for authentication, payments, email, analytics, storage, hosting, and AI processing. We are not responsible for third-party websites, services, terms, policies, outages, or security practices outside our control.

9. Service Availability and Changes

We may modify, pause, replace, or discontinue parts of the Services. We try to maintain reliable access, but we do not guarantee uninterrupted availability, perfect uptime, or that every feature will remain available forever.

10. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free results.

AI Outputs may be inaccurate, incomplete, offensive, or unsuitable for your intended use. You are responsible for reviewing Outputs and deciding whether they are appropriate for your project, publication, or commercial use.

11. Limitation of Liability

To the maximum extent permitted by law, GPT Image Prompt and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, or loss of goodwill.

Where liability cannot be excluded, our total liability for any claim relating to the Services will not exceed the amount you paid to GPT Image Prompt in the 12 months before the event giving rise to the claim, or USD $100 if you did not pay us during that period.

12. Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create legal or security risk, misuse credits, abuse infrastructure, or fail to pay amounts due.

After termination, sections that by their nature should survive will continue to apply, including content rights, payment obligations, disclaimers, limitations of liability, and dispute provisions.

13. Changes to These Terms

We may update these Terms from time to time. The date above shows the latest update. If changes are material, we may provide notice through the website, email, or account notifications. Continued use after the updated Terms become effective means you accept the changes.
